Sending a notice
A notice that can be acted on includes all of the following:
- Your physical or electronic signature, or that of someone who may act for the owner.
- The work you say is infringed.
- Where the material is on Kamano, with enough detail for us to find it: a link, a username or a description.
- Your name, address, telephone number and email.
- A statement that you believe in good faith the use is not allowed by the owner, their agent or the law.
- A statement, under penalty of perjury, that the notice is accurate and that you may act for the owner.
Knowingly misrepresenting that something infringes can make you liable for damages. If you are unsure, ask a lawyer first.
What we do
When a valid notice arrives we remove or disable the material and tell the member who posted it, including what the notice said. The removal appears in their account as a copyright removal with the rule and the reason.
If your content was removed by mistake
You can send a counter-notice to the agent above. It needs:
- Your signature, physical or electronic.
- The material removed and where it was before.
- A statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification.
- Your name, address and telephone number, and that you consent to the courts of your district and will accept a notice from the person who complained.
We pass the counter-notice to the person who complained. If they do not tell us within 10 to 14 business days that they have started a court action, we may restore the material.
Repeat infringers
We close the accounts of members who repeatedly infringe copyright.
